Important Legal Notice
Please be aware that under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing, or that material or activity was removed or disabled by mistake or misidentification, may be subject to liability for damages, including costs and attorneys' fees.
If you are not sure whether material available online infringes your copyright, we suggest that you first contact an attorney before filing a DMCA notification.
For League Organizers
League organizers who upload content have additional responsibilities regarding copyright:
- Ensure you have rights to all content you upload, including music and third-party materials
- Obtain necessary releases from battlers and other participants
- Respond promptly to any DMCA notices involving your content
- Do not re-upload content that has been removed for copyright violation
- Maintain documentation of your rights to uploaded content
Repeated copyright violations by league organizers may result in loss of league organizer privileges or account termination.
A Note on Fair Use
We recognize that some uses of copyrighted material may qualify as "fair use" under U.S. copyright law. Fair use considerations include:
- The purpose and character of the use (commercial vs. educational)
- The nature of the copyrighted work
- The amount and substantiality of the portion used
- The effect on the potential market for the copyrighted work
If you believe your use of copyrighted material constitutes fair use, you may include this argument in a counter-notice. However, fair use is determined on a case-by-case basis, and we encourage you to consult with a legal professional.
